Судья может заменить выдворение на штраф в случае добросовестного отношения к уплате налогов, законопослушного поведения и наличия жилья, а также в ряде других обстоятельств.
Исключения составят случаи назначения наказания по ряду статей КоАП, касающихся, в частности, пропаганды нетрадиционных отношений и смены пола либо уклонения иностранца от выдворения.
