دیوان عدالت اداری در حکمی دستور قرار قبولی موقت دادنامهٔ کروز را صادر کرد و حکم هیئت تجدیدنظر شورای رقابت مبنی بر غیرقانونی‌بودن حضور کروز در هیئت‌مدیرهٔ ایران‌خودرو را تا بررسی نهایی متوقف کرد.
این در حالی است که پیش‌تر معاون حقوق عامه و پیشگیری از وقوع جرم دادستانی کل کشور در ۲ نامه با تأیید نظر هیئت تجدیدنظر شورای رقابت دستور به برگزاری مجمع ایران‌خودرو بدون حضور کروز داده بود.
با توجه به ابهامات جدی در روند واگذاری ایران خودرو به کروز و همچنین بازبودن پروندهٔ فساد این شرکت در محاکم قضایی، نگرانی‌ها از تکرار تجربه‌های خصوصی‌سازی ناموفق مثل پروندهٔ هفت‌تپه در ایران‌خودرو به حداکثر رسیده است.
