Under the Sebi Act, the regulator has the power to carry out search and seizure of books, registers, documents including electronics and digital devices from any person associated with the securities market. However, the perpetrators of such frauds are now adopting new methods and technologies to defraud the investors. For example, WhatsApp restricted the number of times a user could forward something, and developed automated systems that detect and flag objectionable content. Such instructions could actually endanger people — citizens receive air strike warnings via smartphone alerts. Following this, Sebi, in an order passed in January 2022, established that the administrators of a Telegram channel having a large subscriber base enticed the subscribers to act upon recommendations that were circulated by those administrators on the channel, leading to significant price and volume impact in various scrips.
