🔹این یادداشت مربوط به وظیفه شهرداری درباره کنترل و نظارت بر اجرای ساختمان‌ها و شرایط صدور گواهی عدم خلاف و پایان کار ساختمانی از طرف این نهاد و متأسفانه عدول این نهاد از وظایف قانونی و خسارات عمومی وارده ناشی از آن است. بندهای قانونی مرتبط با موضوع مطرح‌شده مرور می‌شود. 1- طبق بند 9 از ماده 2 قانون نظام مهندسی و کنترل ساختمان (مصوب 1374)، الزام به رعایت مقررات ملی ساختمان، ضوابط و مقررات شهرسازی و مفاد طرح‌های جامع و تفصیلی و هادی از سوی تمام دستگاه‌های دولتی، شهرداری‌ها، سازندگان، مهندسان، بهره‌برداران و تمام اشخاص حقیقی و حقوقی مرتبط با بخش ساختمان به‌عنوان اصل حاكم بر همه روابط و فعالیت‌های آنها از اهداف و خط‌مشی‌های این قانون است.
