Hierbei sieht er, da der Verfassungsgerichtshof die fehlende Unabhängigkeit des ORF festgestellt hat, unionsrechtliche Verstöße. Denn nach EU-Recht seien Rundfunkgebühren Beihilfen. Diese seien zwar grundsätzlich verboten, aber im Rundfunkbereich erlaubt, wenn Objektivität und Pluralität im öffentlich-rechtlichen Rundfunk sichergestellt sind.
