Оскільки суди першої та апеляційної інстанцій розглянули спір, який не підлягає судовому розгляду, Верховний Суд дійшов висновку про наявність підстав для скасування рішення Вінницького окружного адміністративного суду від 12 січня 2024 року та постанови Сьомого апеляційного адміністративного суду від 26 червня 2024 року із закриттям провадження у справі.
СУД ПОСТАНОВИВ:
Рішення Вінницького окружного адміністративного суду від 12 січня 2024 року та постанови Сьомого апеляційного адміністративного суду від 26 червня 2024 року скасувати, а провадження у справі № 120/11425/23 закрити.
Оскільки суди першої та апеляційної інстанцій розглянули спір, який не підлягає судовому розгляду, Верховний Суд дійшов висновку про наявність підстав для скасування рішення Вінницького окружного адміністративного суду від 12 січня 2024 року та постанови Сьомого апеляційного адміністративного суду від 26 червня 2024 року із закриттям провадження у справі.

Рішення Вінницького окружного адміністративного суду від 12 січня 2024 року та постанови Сьомого апеляційного адміністративного суду від 26 червня 2024 року скасувати, а провадження у справі № 120/11425/23 закрити.
